In dealing with real estate in family law matters, the valuation of community property assets is paramount to negotiating equitable settlements. Division and/or disposition of real property in a divorce is one of the most complicated and important division of assets.
Included in this presentation will be a discussion of the practical impact of court decisions. There is a need for different types of property valuations: fair market value, rental value from the date of separation, retrospective appraisals to determine fair market value at various times of ownership , as well as the allocation of value to specific improvements that have been made to community or separate property.
